📋 Notice Requirements (17 U.S.C. § 512(c)(3))

To be effective under federal law, a notification of claimed copyright infringement must be a written communication provided to our designated agent that includes substantially the following:

  • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • Identification of the copyrighted work claimed to have been infringed (or, if multiple works, a representative list).
  • Identification of the material claimed to be infringing and information reasonably sufficient to permit us to locate the material (e.g. the specific episode URL).
  • Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and email address.
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

🛑 Creator Repeat Infringer Policy (17 U.S.C. § 512(i))

In accordance with 17 U.S.C. § 512(i)(1)(A), Lingeti has adopted and reasonably implemented a policy that provides for the termination, in appropriate circumstances, of creator accounts who are repeat infringers of copyright.

Enforcement & Termination Policy:

Content creators who upload video or audio materials to the platform are subject to immediate content removal upon receipt of a compliant statutory takedown notice. Accounts accumulating repeated substantiated copyright infringement notices without successful counter-notification will have their creator publishing privileges revoked and accounts permanently terminated.

🔄 Counter-Notification Procedure (17 U.S.C. § 512(g)(3))

If a creator believes that content removed or disabled as a result of a DMCA takedown notice was removed due to mistake or misidentification (including transformative fair use under 17 U.S.C. § 107), the creator may submit a counter-notification to our designated agent. Upon receipt of a valid counter-notification, we will promptly provide the complainant with a copy and inform them that the removed material will be replaced in 10 to 14 business days unless court action seeking a restraining order is initiated.
